Terms of Service
The terms that apply to work we do for you. Plain English wherever possible.

These terms apply to work performed by Ekko Byte (Ekko Byte, ABN 32754404221) for you, the client. By accepting a quote or proposal, you agree to these terms.
1. Quotes and scope
Quotes are valid for 30 days and are based on the scope described in the proposal. Fixed-price packages cover exactly what’s listed there — anything beyond that is additional work.
If you ask for something outside the agreed scope, we’ll tell you before doing it and quote it separately. You will never receive an invoice for work you didn’t agree to.
2. Payment
- A deposit of [50%] is payable before work begins. This secures your place in our schedule.
- The balance is payable on launch.
- Invoices are due within [14] days.
- Ongoing services (hosting, support, IT plans) are billed monthly in advance.
- We may pause work or suspend services on accounts more than [14] days overdue, after giving you notice first.
All prices are in Australian dollars and include GST unless stated otherwise.
3. What we need from you
Projects run to schedule when we get what we need. You agree to:
- provide content, images, logins and feedback within a reasonable time
- nominate one person as the main point of contact and decision maker
- ensure you have the right to use any content, images or trademarks you give us
If a project stalls waiting on your input for more than [30] days, we may invoice for the work completed to that point and reschedule the remainder.
4. Revisions
Fixed-price website packages include two rounds of design revisions before launch. A round means one consolidated set of feedback. Additional rounds, or a change of direction after a design has been approved, are quoted separately.
5. Timeframes
We give honest estimates and work hard to meet them. Estimated timeframes assume timely feedback from you and no significant change in scope. They aren’t guarantees, and we’re not liable for delays caused by circumstances outside our control.
6. Ownership
- Once your invoice is paid in full, you own the final website design, the content we wrote for you, and your logo and brand assets.
- We keep ownership of the underlying tools, code libraries, templates and processes we use across clients. You get a perpetual licence to use them as part of your site.
- Third-party components (themes, plugins, fonts, stock images) remain subject to their own licences.
- Until your invoice is paid in full, ownership stays with us.
You always own your domain name, your content and your data. There is no lock-in.
7. Hosting and support
- Hosting and support plans run month to month with no minimum term.
- Either of us can cancel with [30] days’ notice. Fees already paid for the current month aren’t refunded.
- “Small changes included” means minor text and image updates. Larger work is quoted first.
- We take daily backups, but you should keep your own copies of anything irreplaceable.
- If you leave, we’ll provide an export of your site and content at no charge.
8. Portfolio and credit
Unless you ask us not to, we may show your project in our portfolio and describe the work we did. Tell us in writing at any time and we’ll remove it.
9. Warranties and liability
We’ll perform the work with reasonable care and skill.
We’ll fix genuine faults in our work — bugs, broken links, things not working as specified — free of charge for [60] days after launch. This doesn’t cover changes you make yourself, third-party service failures, or new features.
Nothing in these terms excludes rights you have under the Australian Consumer Law. Where we’re permitted to limit liability, our total liability is limited to the amount you paid us for the work in question. We’re not liable for indirect or consequential loss, including lost profits or lost data.
We don’t guarantee specific search rankings, traffic volumes or sales. We’ll do the work properly; results depend on factors outside our control.
10. Cancellation
If you cancel a project partway through, you’re liable for the work completed to that point, and the deposit is applied against it.
We may cancel if the working relationship becomes unworkable, in which case we’ll refund any amount paid for work not yet done.
11. Confidentiality
We keep your business information confidential and won’t share it beyond what’s needed to do the work. We ask the same of you regarding our pricing and processes.
12. Changes to these terms
We may update these terms. Changes apply to new projects, not to work already underway.
13. Governing law
These terms are governed by the laws of Victoria, Australia.
